Project Got Your Back (PGYB) Supported Persons Agreement
Introduction to PGYB – The goal of PGYB is to foster collaboration among military service organizations and military-connected individuals in need of services. PGYB seeks to help military-connected individuals (“Supported Persons”) coordinate with organizations (“Participating Organizations”) that specifically serve Supported Persons with high-quality services to suit the Supported Person’s unique needs.
PGYB Terms and Conditions – PGYB’s facilitation of services is offered to Supported Persons based on their acceptance of the terms and conditions contained in this agreement. Using PGYB to request service constitutes Supported Person’s agreement to all such terms and conditions. These terms and conditions apply to any PGYB activity. If Supported Person does not agree to these terms and conditions, they may not use PGYB.
Occasionally PGYB may determine or suspect that the Supported Person is misusing or attempting to misuse or circumvent PGYB facilitation services. In that case, PGYB reserves the right to revoke access to any PGYB facilitation services at any time or for any reason.
PGYB Provides No Direct Services – PGYB is a facilitating structure composed of independent volunteers (“PGYB Navigators”) dedicated to connecting Supported Persons to Participating Organizations and tracking their long-term progress. PGYB will receive no financial gain or benefit for any referral of Supported Persons to Participating Organizations. PGYB will not pay PGYB Navigators. PGYB and PGYB Navigators will not request or demand anything from Supported Persons or Participating Organizations contrary to any local, state, or federal law or rule. PGYB and its Navigators will comply with all applicable local, state, and federal regulations and statutes.
The PGYB Navigator’s role is to listen and seek to understand Supported Persons needs and subsequently direct Supported Persons to the appropriate Participating Organizations. Supported Persons can find Participating Organizations using their PGYB Navigator. PGYB may recommend a list of Participating Organizations based upon a Supported Person’s information. The services will be provided to Supported Persons by Participating Organizations, excluding the PRISM networking service, which PGYB will offer to Navigators and Supported Persons free of charge.
PGYB facilitates PGYB Navigators, coordinating contact between Participating Organizations and Supported Persons for a period not to exceed 365 days. PGYB does not provide direct services to Supported Persons or Participating Organizations. For example, PGYB Navigators will not directly offer employment services, housing assistance, medical treatment, or mental health counseling to Supported Persons.
Recommendations from PGYB – After receiving a Supported Person’s information, PGYB Navigators may recommend that the Supported Person request services from one or more Participating Organizations based on the Supported Person’s expressed interests or needs and the Participating Organization’s products or services. PGYB Navigators cannot guarantee that they will match Supported Persons interests or needs with Participating Organizations or that a local Participating Organization is capable or willing to satisfy the Supported Person’s needs.
PGYB’s Liability – While PGYB Navigators may help Supported Persons connect with Participating Organizations and help Participating Organizations connect with Supported Persons, PGYB does not guarantee or warrant the products or services provided by Participating Organizations. Supported Persons must contract with Participating Organizations directly for the provision of services. Supported Persons agree that by using PGYB, its Navigators cannot be held liable for damages or claims, including emotional and psychological injuries resulting from a Supported Person’s interaction with a Participating Organization. PGYB or its Navigators cannot be held responsible for their failure to connect Supported Persons with Participating Organizations.
No Guarantees or Endorsements – Although PGYB takes specific steps to examine the credentials of listed Participating Organizations, PGYB does not guarantee or make any representations regarding the skills or the quality of the products or services provided by Participating Organizations. It is entirely up to each Supported Person to evaluate a Participating Organization’s skills, products, or services before entering into direct contract and reaching an agreement with a Participating Organization. Participating Organizations are not employees or agents of PGYB, nor is PGYB an agent of the Participating Organizations.
Resource and Data Management – PGYB has enabled a non-discoverable, private, personal relationship management platform known as PRISM, allowing each Supported Person and their assigned Navigator to access resources and privately track the progress of their relationship and privately track relationships with others in their own networks. PRISM will provide training on the system’s use to Supported Persons and Navigators and provide duty-specific training for Navigators.
Each Supported Person will have an anonymous identifier created by PRISM. Only the assigned Navigator and the PGYB System Administrator will know the anonymous identifier assigned to each Supported Person. PGYB will never sell a Supported Person’s identifying information or personal data. All reporting by PGYB will have identifying information and personal data for each Supported Person redacted to preserve each Supported Person’s anonymity. The PGYB PRISM system is in no way related to the PRISM system used by the United States National Security Agency to collect metadata and content data through electronic surveillance of electronic communication service providers.
Information Collection – PGYB will not collect and maintain any information explicitly identifying Supported Persons beyond necessary information provided in the initial intake. PGYB will assign each Supported Person a Navigator who will know the Supported Person’s identity and ask each Supported Person to complete a self-assessment. Each Supported Person will be given an anonymous identifier created by PRISM and the self-assessment will be maintained anonymously using the Supported Person’s own unique identifier. Periodically, the PGYB Navigator will ask the Supported Person to complete additional self-assessments to track their progress. The anonymous identifier will also be used for successive self-assessments.
To maintain privacy, PGYB will not retain information held by the anonymous identifier. However, the PGYB Navigator and PGYB System Administrator will know the Supported Person’s identity and anonymous identifier. To provide appropriate services to the Supported Person, the PGYB Navigator will provide relevant Participating Organizations with the Supported Person’s contact information. Further information collected by Participating Organizations will be subject to the policies of the Participating Organization. PGYB may disclose self-assessments and or summaries of the self-assessments to demonstrate Supported Person’s progress, but such disclosures will only be made using the anonymous identifier.
Supported Persons must promise that all private information submitted will be accurate, current, and truthful to the best of their knowledge. Occasionally, PGYB might have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete. In that case, PGYB has the right to refuse to provide Supported Persons any current or future use of PGYB Navigators or PGYB facilitative services.
Supported Persons and Participating Organizations Provided Information Consent – Upon working with PGYB, Supported Persons and Participating Organizations will be prompted to disclose certain data that PGYB might use to respond to Supported Person requests. Supported Persons agree that by providing their data or completing a request, they are entering into a relationship with PGYB Navigators and Participating Organizations and thus agree to be contacted by them. Supported Persons will authorize PGYB Navigators to provide their phone numbers and other contact information to Participating Organizations to help Supported Persons with any requests.
Participating Organizations agree that by providing their information, they are entering into a relationship with PGYB Navigators and Supported Persons and thus agree to be contacted by them.
Release from Damages or Claims – Supported Persons must address any disputes arising from their contact with PGYB Navigators with the offending party directly. Supported Persons agree to release PGYB and PGYB Navigators from any damages or claims. These include consequential and incidental damages of every kind or nature, suspected and unsuspected, known and unknown, and disclosed and undisclosed, arising out of or in any way connected with such disputes and dealings with Participating Organizations.
Participating Organizations must address any disputes arising from their contact with PGYB Navigators with the offending party directly. Participating Organizations agree to release PGYB and PGYB Navigators from any damages or claims. These include consequential and incidental damages of every kind or nature, suspected and unsuspected, known and unknown, and disclosed and undisclosed, arising out of or in any way connected with such disputes and dealings with Supported Persons or other Participating Organizations.
PGYB cannot guarantee the products or services provided by Participating Organizations. It has no obligation to Supported Persons regarding any relationship with Participating Organizations, and it has no responsibility to Participating Organizations regarding any relationship with a Supported Person or other Participating Organizations.
Dispute Resolution Assistance – Notwithstanding the conditions described in the above Release from Damages or Claims paragraphs, PGYB will offer assistance in the form of mediation if required between the parties in question, including PGYB Navigators.
